Acceptable Use Policy

You may use our services, provided that you are of legal age to form a binding contract and are not barred from receiving such services under the laws of the United States or other jurisdictions. In order to access our services, you are required to provide current and factual identification, contact, and other information as part of the registration process. You are responsible for the confidentiality of your account information and for all activities that occur under your account. You are solely responsible for all content within your account. You agree to immediately notify VPSNINE of any unauthorized use of your account or any other breach of security. VPSNINE will not be liable for any loss or damage as a result of your failure to provide us with accurate information or to keep your account secure.

1 Cancellations and Refunds

a)Any abuse of our staff in any medium or format will result in the suspension or termination of your services.
b)We have a 7 days moneyback policy.
You are not eligible for a refund for the following causes:
1. VPS that are being suspended or terminated for breaking the TOS
2. Purchasing of other addons like (CPanel, WHMCS, DirectAdmin and other addons we offer)
3. We did not receive a valid reason for refund.
4. When you cancel and you have enabled a Paypal automatic payment you need to cancel that automatic payment in Paypal, they do not allow us to do this. If you fail to do this we will not be responsible and will not refund any amounts that you then pay in error.
5. Cases of suspected fraud, using the service for sending spam or any other type of abuse.

2 Acceptable Use Policy (AUP)

VPS accounts may not:
a) Host copyrighted materials, or files related to hacking and other illegal materials.
b) host anything related to gambling, porn or any other activities of a dubious nature.
c) All materliased hosted must be suitable for viewing by kids of any age
d) exceed a 15 minute load average greater than two (2) times the amount of CPU cores given.
e) run public IRCd's or malicious bots.
f) run any type of BitTorrent client or tracker
g) use as an Open/Public proxy
h) utilize a proxy to access illegal/malicious content.
i) use I/O intensive applications which adversely affect normal server operations.
j) use bandwidth intensive applications which adversely affect normal server operations.

3 Mail Policy

a. The list must be a Double Opt-In list. This means a user has subscribed for a newsletter or other email marketing messages by explicitly requesting it and confirming the email address to be their own. Confirmation is usually done by responding to a notification/confirmation email sent to the email address the end user specified. The double opt-in method eliminates the chance of abuse where somebody submits someone else's email address without their knowledge and against their will. You will not be permitted to mail any mailing list that you were given or purchased. In doing so, this will also be considered spamming and may result in termination of the offending account.

b. Any unsolicited e-mail being sent will result in suspension or termination of the offending account. We take a zero tolerance stance against sending of unsolicited e-mail and other forms of spam.
